AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 583 amends current law relating to donations to certain local veteran's charities ordered as a condition of community supervision.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 16(f), Article 42.12, Code of Criminal Procedure, as follows:

 

(f) Authorizes a judge, in lieu of requiring a defendant to work a specified number of hours at a community service project or projects under Subsection (a) (authorizing a judge to require as a condition of community supervision that the defendant work a specified number of hours at a community service project or projects for a certain organization or organizations) to order a defendant to make a specified donation to a nonprofit food bank or food pantry in the community in which the defendant resides or a charitable organization engaged primarily in performing charitable functions for veterans in the community in which the defendant resides. Defines "charitable organization" and "veteran" for purposes of this subsection.

 

SECTION 2. Effective date: September 1, 2015.
