BACKGROUND AND PURPOSE

Interested parties note that currently, the administrative responsibilities of the Texas Military Preparedness Commission fall solely on the director of the commission. These parties assert that the duties of the commission would be better performed if the director shared these responsibilities with an assistant. C.S.H.B. 882 seeks to address this issue.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

C.S.H.B. 882 amends the Government Code to require the Texas Military Preparedness Commission, subject to approval of the governor, to hire an assistant director to assist the director of the commission in the performance of the commission's administrative duties. The bill requires the commission, in hiring the director and the assistant director, to consider applicants who have significant and extensive experience and knowledge relating to military installation operations, the defense industry, and the United States Department of Defense, including retired senior military officers from any branch of the United States armed forces. The bill prohibits the director from holding another position in the office of the governor.

September 1, 2015.

SECTION 1.  Section 436.057, Government Code, is amended by adding Subsections (a-1), (b), and (d) to read as follows: (a-1)  The commission shall hire an assistant director to assist the director in the performance of the administrative duties of the commission. (b)  Either the director or the assistant director must be recently retired from the armed forces with a rank of colonel or above in the army, marines, or air force or captain or above in the navy or coast guard. (d)  The director may not hold another position in the office of the governor.	SECTION 1.  Section 436.057, Government Code, is amended by adding Subsections (a-1), (b), and (d) to read as follows: (a-1)  The commission shall, subject to approval of the governor, hire an assistant director to assist the director in the performance of the administrative duties of the commission. (b)  The commission, in hiring the director and the assistant director,  shall consider applicants who have significant and extensive experience and knowledge relating to military installation operations, the defense industry, and the United States Department of Defense, including retired senior military officers from any branch of the armed forces of the United States. (d)  The director may not hold another position in the office of the governor.
