BACKGROUND AND PURPOSE

 

Interested parties have expressed concerns regarding the current requirement of mailing certain financial statement forms to municipal offices and to each candidate for a municipal office filled by election. H.B. 1246 seeks to make the process more efficient and feasible by amending the applicable law.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1246 amends the Local Government Code to change the delivery requirement for the personal financial statement form sent to municipal officeholders and candidates for municipal office who are required to file a financial statement from requiring the clerk or secretary of the municipality to mail two copies of the form to each applicable municipal officeholder and a copy of the form to each applicable candidate for a municipal office to instead requiring the clerk or secretary to deliver at least one copy of the form by mail, personal delivery, or e-mail or any other means of electronic transfer to each applicable person.

September 1, 2015.
