AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1415 is a follow up to S.B. 131, passed by the 82nd Legislature, authorizing the City of Schertz to establish a cemetery on or before September 1, 2014. Due to an economic downturn, the city was unable to develop the land for this purpose. H.B. 1415 seeks to remove the deadline by which the cemetery must be established.

 

H.B. 1415 removes the deadline for the City of Schertz to establish a cemetery.

 

H.B. 1415 amends current law relating to establishment or use of cemeteries in certain municipalities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Redesignates Subsection (h), Section 711.008, Health and Safety Code, as added by Chapter 367 (S.B. 131), Acts of the 82nd Legislature, Regular Session, 2011, as Subsection (i), Section 711.008, Health and Safety Code, and amends it as follows:

 

(i) Redesignates existing Subsection (h) as Subsection (i) and deletes existing deadline relating to a person filing a written application with the governing body of a municipality to establish or use a cemetery located inside the boundaries of the municipality. Makes no further change to this subsection.

 

SECTION 2.  Effective date: upon passage or September 1, 2015.
