Committee Report (Unamended) |
BACKGROUND AND PURPOSE
Recent legislation amended the law relating to cemeteries in certain municipalities in order to address the desire of such municipalities to establish a cemetery, other than a family cemetery, within the boundaries of those municipalities. Interested parties note that an expired deadline now exists in the law, and H.B. 1415 seeks to address this issue.

|
RULEMAKING AUTHORITY

ANALYSIS
H.B. 1415 redesignates and amends a Health and Safety Code provision to remove the expired deadline by which a person must have filed a written application to establish or use a cemetery located inside the boundaries of a municipality with the governing body of a municipality that is located in three or more counties, has a population of 18,000 or more, and does not have a cemetery within its boundaries, other than a family cemetery. The bill retains the authorization for a person to file such an application.
