BACKGROUND AND PURPOSE

 

Interested parties contend that current building construction codes allow an industrialized home or building to be built up to four stories but that state law limits the maximum number of stories for such structures to three stories.  H.B. 1990 seeks to remedy this inconsistency.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1990 amends the Occupations Code to change the maximum height over which a residential structure does not meet the definition of industrialized housing from three stories or 49 feet in height to four stories or 60 feet in height. The bill changes the maximum height over which certain commercial structures do not meet the definition of an industrialized building from three stories or 49 feet in height to four stories or 60 feet in height.
