AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Fort Bend County Municipal Utility District No. 182 was created by the legislature several years ago with the authority to oversee road projects. However, interested parties note that the enacting legislation limited that authority to the area inside the district. The parties stress the importance of granting the district authority to oversee road projects outside the district so that the district can address all road projects impacting development within the district. H.B. 2092 seeks to address this concern.

 

H.B. 2092 amends the Special District Local Laws Code to expand the authority of the Fort Bend County Municipal Utility District No. 182 to construct, acquire, improve, maintain, or operate macadamized, graveled, or paved roads or turnpikes, or improvements in aid of those roads or turnpikes, inside the district to provide for such activities outside the district. The bill establishes that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the bill's effective date.

 

H.B. 2092 amends current law relating to the road powers of the Fort Bend County Municipal Utility District No. 182.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 8176.051(a), Special District Local Laws Code, to authorize the Fort Bend County Municipal Utility District No. 182 (district) to construct, acquire, improve, maintain, or operate macadamized, graveled, or paved roads or turnpikes, or improvements in aid of those roads or turnpikes, inside or outside the district, rather than inside the district.

 

SECTION 2. Provides that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the effective date of this Act.

 

SECTION 3. Effective date: September 1, 2015.
