BACKGROUND AND PURPOSE

Interested parties point out that district clerks are required to display official legal notices by posting a physical document at a place convenient for public viewing in the clerk's office but that county clerks have the ability to post these notices electronically. The parties assert that posting an official legal notice by electronic display provides readily available and accessible information to the public. In an effort to further accommodate an emerging technological society, H.B. 2234 provides for this method of electronic posting by district clerks.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2234 amends the Government Code to authorize a district clerk to post an official and legal notice by electronic display, instead of posting a physical document, in the manner provided under statutory provisions relating to electronic display of such notices by a county clerk.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
