BACKGROUND AND PURPOSE

 

Interested parties note that state law does not expressly allow for a non-historic area within a historic site to be named after a donor or other benefactor. The parties contend that such naming should be allowed in certain cases. H.B. 2332 seeks to address this issue.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that rulemaking authority is expressly granted to the Texas Historical Commission in SECTION 1 of this bill.

 

ANALYSIS

 

H.B. 2332 amends the Government Code to authorize the Texas Historical Commission to name an area of a historic site, including a room or exhibition hall, in honor of a donor or other benefactor as the commission considers appropriate, provided the area does not have historical value. The bill requires the commission to adopt rules to implement these provisions as soon as practicable after the bill's effective date.

September 1, 2015.
