BACKGROUND AND PURPOSE

 

Interested parties have expressed the need for North Fort Worth Water Control and Improvement District No. 1 of Denton and Wise Counties, located in the extraterritorial jurisdiction of the City of Fort Worth, to be renamed as the Shale Creek Water Control and Improvement District and provided with roadway powers. H.B. 2501 seeks to address this need.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2501 amends the Special District Local Laws Code to rename the North Fort Worth Water Control and Improvement District No. 1 of Denton and Wise Counties as the Shale Creek Water Control and Improvement District. The bill grants the district the power to undertake certain road projects, including joint road projects and road contracts, and provides for improvement projects or services in a definable area. The bill authorizes the district, subject to certain requirements, to issue obligations, impose operation and maintenance taxes, and impose taxes or levy a special assessment to pay the principal of and interest on bonds issued to pay for an authorized road project.

 

H.B. 2501 establishes that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the bill's effective date. The bill provides for the validation and confirmation of the creation and renaming of the North Fort Worth Water Control and Improvement District No. 1 of Denton and Wise Counties and certain district actions and proceedings occurring before the bill's effective date. The bill's validation and confirmation provisions do not apply to an act, proceeding, director, other official, bond, or other obligation the validity of which or of whom is the subject of litigation that is pending on the bill's effective date or an act or proceeding that, under state or federal law, was a misdemeanor or felony at the time the act or proceeding occurred.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
