BACKGROUND AND PURPOSE

 

Interested parties have expressed the need for the South Denton County Water Control and Improvement District No. 1, located in the extraterritorial jurisdiction of the City of Fort Worth, to be renamed as the Brookfield Water Control and Improvement District and to be provided with roadway powers. H.B. 2509 seeks to address this need.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2509 amends the Special District Local Laws Code to rename the South Denton County Water Control and Improvement District No. 1 as the Brookfield Water Control and Improvement District and to establish provisions relating to the latter district to provide certain improvements, projects, and services for public use and benefit. The bill provides for, among other provisions, authority for road projects and joint road projects, road contracts, and the undertaking of an improvement project or service in a definable area. The district's powers and duties include, subject to certain requirements, the authorization to issue obligations, impose property and operation and maintenance taxes and taxes to repay obligations, and levy a special assessment to pay the principal of and interest on obligations issued to pay for an authorized road project. The bill establishes that the district retains all rights, powers, privileges, authorities, duties, and functions that it had before the bill's effective date. The bill provides for the validation and confirmation of the creation of the South Denton County Water Control and Improvement District No. 1, the renaming of that district as the Brookfield Water Control and Improvement District, and certain district actions and proceedings taken not more than three years before the bill's effective date. The bill's validation and confirmation provisions do not apply to an act, proceeding, director, other official, bond, or other obligation the validity of which or of whom is the subject of litigation that is pending on the bill's effective date.

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
