AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 2589 amends current law relating to the prosecution of and punishment for assaulting a disabled individual; increasing a criminal penalty.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 22.021(b), Penal Code, by amending Subdivision (2) to redefine "elderly individual" and adding Subdivision (3) to define "disabled individual" to mean a person older than 13 years of age who by reason of age or physical or mental disease, defect, or injury is substantially unable to protect the person's self from harm or to provide food, shelter, or medical care for the person's self.

 

SECTION 2. Makes application of this Act prospective.

 

SECTION 3. Effective date: September 1, 2015.
