BACKGROUND AND PURPOSE

Across the state, there are a number of nonprofit charities that benefit their respective communities by raising money throughout the year, often through raffles, for different philanthropic causes such as providing school supplies for needy children, supporting victims of domestic violence, or providing food and medical care for indigent constituents. However, there is concern that the laws regulating the number of raffles an organization may hold annually are severely limiting their efforts to support these causes. H.B. 2745 seeks to eliminate this barrier.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2745 repeals Sections 2002.052(a) and (b), Occupations Code, relating to the limit of two charitable raffles that a qualified organization is authorized to conduct in a calendar year under the Charitable Raffle Enabling Act.

H.B. 2745 amends the Occupations Code to make a conforming change.

EFFECTIVE DATE

September 1, 2015.
