BACKGROUND AND PURPOSE

According to interested parties, recently enacted legislation allows many types of entities, including Texas water districts, to move their elections to November. The parties express concern that the law conflicts with provisions of law applicable to all water districts that mandate May elections for water district board members. H.B. 2985 seeks to address this inconsistency in Texas law.   

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2985 amends the Water Code to remove the specification that the uniform election date on which a directors election for certain water districts is required to be held is the uniform election date in May of each even-numbered year.

EFFECTIVE DATE

September 1, 2015.
