BACKGROUND AND PURPOSE

 

Interested parties note that many requirements relating to animal crematories exceed the standards for human crematories. The parties assert that these requirements are burdensome and result in regulation of these establishments to a degree that is harmful to the industry. H.B. 3026 seeks to ease excessive burdens that threaten the availability of animal crematory services. 

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3026 amends the Health and Safety Code to require the Texas Commission on Environmental Quality, in establishing requirements for a permit by rule under the Texas Clean Air Act, to use the same criteria and requirements for animal crematories that are used for human crematories.

 

EFFECTIVE DATE

 

September 1, 2015.
