BACKGROUND AND PURPOSE

 

Currently, the commissioners court of a county may donate up to $25,000 each year to a crime stoppers or crime prevention organization, regardless of county population. C.S.H.B. 3067 seeks to allow the commissioners court of a county with a certain minimum population to donate up to a higher maximum amount.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 3067 amends the Local Government Code to raise from $25,000 to $100,000 the cap on the total amount the commissioners court of a county with a population of one million or more may donate in a calendar year by contract to one or more crime stoppers or crime prevention organizations for expenditure by the organizations to meet the organization's goals.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.

SECTION 1.  Section 351.901(b), Local Government Code, is amended to read as follows:

(b)  The commissioners court of a county by contract may donate money to one or more crime stoppers or crime prevention organizations for expenditure by the organizations to meet the goals identified in Subsection (a). The total amount of all donations made in a calendar year may not exceed:

(1)  $25,000; or

(2)  $100,000, for a county with a population of 3.3 million or more.

SECTION 1.  Section 351.901(b), Local Government Code, is amended to read as follows:

(b)  The commissioners court of a county by contract may donate money to one or more crime stoppers or crime prevention organizations for expenditure by the organizations to meet the goals identified in Subsection (a). The total amount of all donations made in a calendar year may not exceed:

(1)  $25,000; or

(2)  $100,000, for a county with a population of one million or more.

SECTION 2.  This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2015.
