BACKGROUND AND PURPOSE

 

Interested parties explain that associations of regional governments in Texas, commonly known as councils of government, regional planning commissions, or development councils, consist of city and county leaders who work together for the betterment of the entire region. These organizations are required to offer a member of the legislature who represents a district located in the applicable region membership in the organization as a nonvoting, ex officio member. However, the parties contend that this requirement does not provide for each legislative member who represents a district in the region to be offered that membership. C.S.H.B. 3167 addresses this issue by amending the applicable law.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 3167 amends the Local Government Code to make the requirement that the governing body of a regional planning commission, council of governments, or similar regional planning agency of a region that is consistent with the geographic boundaries of a state planning region offer ex officio, nonvoting membership on the governing body to a member of the legislature who represents a district located wholly or partly in the region of the commission applicable with respect to each member of the legislature who represents a district located wholly or partly in the region of the commission. The bill establishes that an ex officio member is not counted for purposes of determining a quorum.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.

SECTION 1.  Section 391.006(c), Local Government Code, is amended to read as follows:

 

(c)  The governing body of a commission of a region that is consistent with the geographic boundaries of a state planning region shall offer an ex officio, nonvoting membership on the governing body to each [a] member of the legislature who represents a district located wholly or partly in the region of the commission.

 

SECTION 1.  Section 391.006, Local Government Code, is amended by amending Subsection (c) and adding Subsection (d) to read as follows:

(c)  The governing body of a commission of a region that is consistent with the geographic boundaries of a state planning region shall offer an ex officio, nonvoting membership on the governing body to each [a] member of the legislature who represents a district located wholly or partly in the region of the commission.

(d)  An ex officio member is not counted for purposes of determining a quorum.

 

SECTION 2.  This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2015.
