BACKGROUND AND PURPOSE

 

Interested parties contend that some land use regulations are unnecessary, particularly certain regulations limiting the number of people who may assemble on land annexed by a municipality for limited purposes. H.B. 3299 seeks to address this type of unnecessary regulatory practice.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3299 amends the Local Government Code to prohibit a municipality from enforcing an ordinance or rule that limits the number of people who may assemble on property located in an area that the municipality annexed for limited purposes if the ordinance or rule would restrict the number of people authorized to assemble on the property to less than what the fire prevention authority with jurisdiction over the property has authorized by permit. The bill defines "fire prevention authority" as a county fire marshal, a municipal fire department, an emergency services district, or any local agency that provides emergency medical services to the area.

September 1, 2015.
