H.B. 4180

By: Zerwas

Special Purpose Districts

Committee Report (Unamended)

BACKGROUND AND PURPOSE

Interested parties note that the Harris-Fort Bend Counties Municipal Utility District No. 4 currently provides critical public infrastructure improvements, including water, sewer, drainage, road, and recreational facilities in certain areas of both Harris County and Fort Bend County. The parties assert that because the district is located in the City of Katy, the district should be converted to the Katy Management District No. 1. H.B. 4180 seeks to provide for this conversion.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 4180 converts the Harris-Fort Bend Counties Municipal Utility District No. 4 to the Katy Management District No. 1. The bill amends the Special District Local Laws Code to establish provisions relating to the Katy Management District No. 1 to provide certain improvements, projects, and services for public use and benefit. The bill provides for, among other provisions, municipal utility district powers and duties and the annexation of land by the district. The district's powers and duties include, subject to certain requirements, the authorization to issue obligations and impose assessments and property, operation and maintenance, and contract taxes.

H.B. 4180 establishes that the Katy Management District No. 1 retains all rights, powers, privileges, authorities, duties, and functions that the Harris-Fort Bend Counties Municipal Utility District No. 4 had before the bill's effective date, except as otherwise expressly provided by the bill's provisions. The bill provides for the validation and confirmation of certain actions and proceedings of the Harris-Fort Bend Counties Municipal Utility District No. 4 taken before the bill's effective date.

EFFECTIVE DATE
