BACKGROUND AND PURPOSE

 

Interested parties note that the Texas Commission on Environmental Quality recently changed the name of the Corn Hill Regional Water Authority to the Lone Star Regional Water Authority. C.S.H.B. 4187 seeks to amend statute to reflect this name change and address an issue relating to the appointment of authority directors.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 4187 amends the Special District Local Laws Code to rename the Corn Hill Regional Water Authority as the Lone Star Regional Water Authority. The bill establishes an exception to the requirement that each member entity appoint two directors to the authority's board of directors to authorize the board, at any time the number of member entities is more than five, to adopt a resolution providing that each member entity shall appoint one director. The bill requires the resolution to be approved by an affirmative vote of not less than 75 percent of the directors then serving, with at least one director from each member entity present and voting in favor of the resolution. The bill requires the terms of the directors serving when the board passes the resolution to expire on the first day of September following the date the resolution is adopted and requires each member entity to appoint one director not later than the first day of October following such date.

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.

SECTION 5.  (a)  The legal notice of the intention to introduce this Act, setting forth the general substance of this Act, has been published as provided by law, and the notice and a copy of this Act have been furnished to all persons, agencies, officials, or entities to which they are required to be furnished under Section 59, Article XVI, Texas Constitution, and Chapter 313, Government Code.

(b)  The governor, one of the required recipients, has submitted the notice and Act to the Texas Commission on Environmental Quality.

(c)  The Texas Commission on Environmental Quality has filed its recommendations relating to this Act with the governor, the lieutenant governor, and the speaker of the house of representatives within the required time.

(d)  All requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

SECTION 6.  This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2015.
