BACKGROUND AND PURPOSE

Interested parties note that land within the Dowdell Public Utility District is undeveloped. The parties contend that the district needs authority to establish a defined area within the district to develop the land without increasing the overall tax burden for other district taxpayers. The parties further contend that the district needs road powers for the proper development of the defined area and the entire district. H.B. 4206 seeks to address these needs.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 4206 amends the Special District Local Laws Code to establish provisions relating to the Dowdell Public Utility District. The bill grants the district the power to undertake certain road projects and provides for district's authority to establish defined areas. The bill authorizes the district, subject to certain requirements, to issue obligations and impose property taxes and impact fees. The bill establishes that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the bill's effective date. The bill provides for the validation and confirmation of certain district actions and proceedings taken before the bill's effective date.

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
