AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

This bill authorizes certain county sheriffs to inspect commercial vehicles to enforce federal safety regulations.

 

S.B. 58 amends current law relating to the enforcement of commercial vehicle safety standards by certain municipalities and counties.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Sections 644.101(b) and (c), Transportation Code, as follows:

 

(b) Provides that a police officer of any of the municipalities as set forth is eligible to apply for certification under this section, including a municipality with a population of more than 40,000 and less than 50,000 that is located in a county with a population of more than 285,000 and less than 300,000 that borders the Gulf of Mexico.

 

(c) Provides that a sheriff or deputy sheriff of a county bordering the United Mexican States or of a county with a population of 700,000 or more, rather than one million or more, is eligible to apply for certification under this section.

 

SECTION 2. Effective date: September 1, 2015.
