BILL ANALYSIS

S.B. 382

Public Education

Committee Report (Unamended)

BACKGROUND AND PURPOSE

Interested parties note that while each public school must have an automated external defibrillator on campus and make available related training for volunteers and district staff, the only people on a school campus required to be trained in using such a device are school nurses, assistant nurses, and athletic personnel. The parties believe this limitation means that a school is not required or encouraged to offer the training to a significant number of personnel who are present on a school campus during the majority of the school day. S.B. 382 seeks to address this issue.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that rulemaking authority is expressly granted to the State Board for Educator Certification in SECTION 1 of this bill.

ANALYSIS

S.B. 382 amends the Education Code to require the State Board for Educator Certification to adopt rules allowing an educator to receive credit towards the educator's continuing education requirements for completion of an instructional course on the use of an automated external defibrillator that meets the guidelines for automated external defibrillator training approved under the Health and Safety Code.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
