BACKGROUND AND PURPOSE

Recent legislation gave brewpubs the authority to sell their products to distributors and other retailers. Interested parties note that while it is the current practice of brewpubs to obtain label approval to ensure that the product is properly registered with the state, this practice is not reflected in the Alcoholic Beverage Code. S.B. 858 seeks to address this issue by amending the applicable law.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 858 amends the Alcoholic Beverage Code to include a brewpub licensee among the alcoholic beverage license and permit holders authorized to apply for and receive label approval on beer, ale, or malt liquor.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2015.
