AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1264 amends the Occupations Code to increase the maximum height allowed for industrialized housing and industrialized buildings to four stories or 60 feet in height.

 

Current law limits the maximum number of stories and height an industrialized home or building can be built to three stories or 49 feet. Interested parties contend under current building construction codes they could build up to four stories, but are limited by current law.

 

S.B. 1264 amends current law relating to the regulation of certain industrialized housing and industrialized buildings.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 1202.002(c), Occupations Code, to provide that industrialized housing does not include:

 

(1) a residential structure that exceeds four stories or 60 feet in height, rather than three stories or 49 feet in height;

 

(2) and (3) Makes no change to these subdivisions.

 

SECTION 2. Amends Section 1202.003(d), Occupations Code, to provide that an industrialized building includes a permanent commercial structure and a commercial structure designed to be transported from one commercial site to another commercial site but does not include:

 

(1) a commercial structure that exceeds four stories or 60 feet in height, rather than three stories or 49 feet in height; or

 

(2) Makes no change to this subdivision.

 

SECTION 3. Effective date: September 1, 2015.
