AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1634 removes the eminent domain powers of The Goforth Special Utility District outside of its geographic boundaries.   

 

C.S.S.B. 1634 removes provisions in the filed version, and limits the use of eminent domain authority outside the boundaries of the Goforth Special Utility District to those projects that are owned and operated by the district.

 

C.S.S.B. 1634 amends current law relating to limiting certain powers of the Goforth Special Utility District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter C, Chapter 7212, Special District Local Laws Code, by adding Section 7212.103, as follows:

 

Sec. 7212.103.  LIMIT ON EMINENT DOMAIN POWER. Prohibits the Goforth Special Utility District (district) from exercising the power of eminent domain to condemn property outside the boundaries or service area of the district unless the district exercises that power for a project the district owns and operates.

 

SECTION 2. Effective date: upon passage or September 1, 2015.
