AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Sergeant Michael Naylor of Midland was killed in the line of duty as he and fellow deputies were serving a routine warrant in October 2014. This bill seeks to honor Sergeant Naylor's service by designating State Highway 191 in Midland County as the Sergeant Michael Naylor Memorial Highway.
S.B. 2041 amends the Transportation Code to designate a portion State Highway 191 in Midland County as the Sergeant Michael Naylor Memorial Highway.
As proposed, S.B. 2041 designates a portion of State Highway 191 in Midland County as the Sergeant Michael Naylor Memorial Highway.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter B, Chapter 225, Transportation Code, is amended by adding Section 225.102, as follows:
Sec. 225.102. SERGEANT MICHAEL NAYLOR MEMORIAL HIGHWAY. (a) Providing that, notwithstanding Section 225.001(c) (authorizing a part of the highway system, including a bridge or street, to be designated by the name of a person only if the person is deceased and was significant in the state's history, or in the lives of the people of this state), the portion of State Highway 191 is designated as the Sergeant Michael Naylor Memorial Highway. Provides that the designation is in addition to any other designation.
(b) Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (prohibiting TxDOT from designing, constructing, or erecting a marker under this subchapter unless a grant or donation of funds is made to TxDOT to cover the cost of the design, construction, and erection of the marker), to:
(1) design and construct markers indicating the designation as the Sergeant Michael Naylor Memorial Highway and any other appropriate information; and
(2) erect a marker at each end of the highway and at appropriate intermediate sites along the highway.
SECTION 2. Requires TxDOT to comply with Section 225.102, Transportation Code, as added by this Act, after the construction of the portion of State Highway 191 designated as the Sergeant Michael Naylor Memorial Highway by this Act is complete.
SECTION 3. Effective date: upon passage or September 1, 2015.
