A BILL TO BE ENTITLED
 
AN ACT
  relating to benefits for a refill of a prescription drug by a health
  benefit plan issuer.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 1369, Insurance Code, is
  amended by adding Section 1369.058 to read as follows:
         Sec. 1369.058.  PAYMENT FOR REFILLS. A health benefit plan
  issuer may not deny benefits for a refill, regardless of whether the
  refill is early, of a prescription drug that is covered under the
  plan and for which benefits have previously been paid under the plan
  if the quantity limit, if applicable, for the drug has not been
  exceeded after the refill.
         SECTION 2.  Section 1369.058, Insurance Code, as added by
  this Act, applies only to a health benefit plan that is delivered,
  issued for delivery, or renewed on or after January 1, 2016. A
  health benefit plan delivered, issued for delivery, or renewed
  before January 1, 2016, is governed by the law in effect as it
  existed immediately before the effective date of this Act, and that
  law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2015.
