A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to benefits for a refill of a prescription drug by a health |
|
|
benefit plan issuer. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 1369, Insurance Code, is |
|
|
amended by adding Section 1369.058 to read as follows: |
|
|
Sec. 1369.058. PAYMENT FOR REFILLS. A health benefit plan |
|
|
issuer may not deny benefits for a refill, regardless of whether the |
|
|
refill is early, of a prescription drug that is covered under the |
|
|
plan and for which benefits have previously been paid under the plan |
|
|
if the quantity limit, if applicable, for the drug has not been |
|
|
exceeded after the refill. |
|
|
SECTION 2. Section 1369.058, Insurance Code, as added by |
|
|
this Act, applies only to a health benefit plan that is delivered, |
|
|
issued for delivery, or renewed on or after January 1, 2016. A |
|
|
health benefit plan delivered, issued for delivery, or renewed |
|
|
before January 1, 2016, is governed by the law in effect as it |
|
|
existed immediately before the effective date of this Act, and that |
|
|
law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
