A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the failure to attend school for part of a day. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 25.094, Education Code, is amended by |
|
adding Subsection (a-1) to read as follows: |
|
(a-1) For purposes of Subsection (a), an individual fails to |
|
attend school on a part of a day only if the individual misses: |
|
(1) more than 15 percent of an instructional day; or |
|
(2) more than 15 percent of a class period. |
|
SECTION 2. Section 51.03, Family Code, is amended by adding |
|
Subsection (h) to read as follows: |
|
(h) For purposes of Subsection (b)(2), a child is absent for |
|
a part of a day only if the child misses: |
|
(1) more than 15 percent of an instructional day; or |
|
(2) more than 15 percent of a class period. |
|
SECTION 3. The change in law made by this Act applies only |
|
to an offense committed or conduct violating a penal law that occurs |
|
on or after the effective date of this Act. An offense committed or |
|
conduct that occurs before the effective date of this Act is |
|
governed by the law in effect on the date the offense was committed |
|
or conduct occurred, and the former law is continued in effect for |
|
that purpose. For purposes of this section, an offense was |
|
committed or conduct violating a penal law occurred before the |
|
effective date of this Act if any element of the offense or |
|
violation occurred before that date. |

SECTION 4. This Act takes effect September 1, 2015. |
