A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the requirement that a pharmacist honor a prescription |
|
written by a practitioner. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 562, Occupations Code, is |
|
amended by adding Section 562.058 to read as follows: |
|
Sec. 562.058. PHARMACIST REQUIRED TO HONOR PRESCRIPTION. |
|
(a) Subject to the provisions of Subchapter A relating to drug |
|
selection and substitution and except as provided by Subsection |
|
(b), a pharmacist shall honor a valid prescription drug order |
|
written by a practitioner licensed by the State of Texas, including |
|
a prescription drug order for a controlled substance or dangerous |
|
drug. |
|
(b) The provisions of Subsection (a) shall not alter a |
|
pharmacist's right to conscientiously object to the filling of any |
|
prescription drug order. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided |
|
by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
