A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement that a pharmacist honor a prescription
  written by a practitioner.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 562, Occupations Code, is
  amended by adding Section 562.058 to read as follows:
         Sec. 562.058.  PHARMACIST REQUIRED TO HONOR PRESCRIPTION.
  (a) Subject to the provisions of Subchapter A relating to drug
  selection and substitution and except as provided by Subsection
  (b), a pharmacist shall honor a valid prescription drug order
  written by a practitioner licensed by the State of Texas, including
  a prescription drug order for a controlled substance or dangerous
  drug.
         (b)  The provisions of Subsection (a) shall not alter a
  pharmacist's right to conscientiously object to the filling of any
  prescription drug order.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided
  by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
