A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to permitting a residency requirement for police officers |
|
|
in certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 150.021(b), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(b) The prohibition under Subsection (a) does not apply to |
|
|
residency requirements for: |
|
|
(1) candidates for or holders of a municipal office, |
|
|
including a position on the governing body of the municipality; |
|
|
[or] |
|
|
(2) municipal department heads appointed by the mayor |
|
|
or governing body of the municipality; or |
|
|
(3) peace officers as defined by Article 2.12, Code of |
|
|
Criminal Procedure, or other law, employed by a municipality with a |
|
|
population of two million or more. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
