A BILL TO BE ENTITLED
 
AN ACT
  relating to the possession of certain weapons by a security guard on
  the premises of a school or educational institution.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 46.03, Penal Code, is amended by adding
  Subsection (j) to read as follows:
         (j)  It is an exception to the application of Subsection
  (a)(1) that the actor possessed a firearm or club while traveling to
  or from the actor's place of assignment or in the actual discharge
  of the actor's duties as a security officer if:
               (1)  the actor holds a security officer commission
  issued by the Texas Private Security Board;
               (2)  the actor is wearing a distinctive uniform; and
               (3)  the firearm or club is in plain view.
         SECTION 2.  The change in law made by this Act applies only
  to an offense committed on or after the effective date of this Act.
  An offense committed before the effective date of this Act is
  governed by the law in effect on the date the offense was committed,
  and the former law is continued in effect for that purpose. For
  purposes of this section, an offense was committed before the
  effective date of this Act if any element of the offense occurred
  before that date.
         SECTION 3.  This Act takes effect September 1, 2015.
