A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to space utilization and online enrollment requirements |
|
|
for the issuance of revenue bonds by certain public institutions of |
|
|
higher education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 55.13, Education Code, is amended by |
|
|
adding Subsections (d), (e), and (f) to read as follows: |
|
|
(d) Notwithstanding any other provision of this chapter or |
|
|
other law, the board of a general academic teaching institution |
|
|
other than a public state college, or the Texas Public Finance |
|
|
Authority on behalf of that institution, if applicable, may not |
|
|
under this chapter issue bonds payable from revenue funds of the |
|
|
institution unless the institution has satisfied the standards |
|
|
prescribed by the Texas Higher Education Coordinating Board for: |
|
|
(1) space utilization in educational and general |
|
|
buildings and facilities at the institution; and |
|
|
(2) the percentage of students enrolled in the |
|
|
institution who enroll in online courses offered by the |
|
|
institution. |
|
|
(e) The Texas Higher Education Coordinating Board may adopt |
|
|
rules for the administration of Subsection (d). |
|
|
(f) In this section, "educational and general buildings and |
|
|
facilities," "general academic teaching institution," and "public |
|
|
state college" have the meanings assigned by Section 61.003. |
|
|
SECTION 2. The change in law made by this Act does not |
|
|
affect the validity of any bonds the issuance of which was |
|
|
authorized before the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
