A BILL TO BE ENTITLED
 
AN ACT
  relating to space utilization and online enrollment requirements
  for the issuance of revenue bonds by certain public institutions of
  higher education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 55.13, Education Code, is amended by
  adding Subsections (d), (e), and (f) to read as follows:
         (d)  Notwithstanding any other provision of this chapter or
  other law, the board of a general academic teaching institution
  other than a public state college, or the Texas Public Finance
  Authority on behalf of that institution, if applicable, may not
  under this chapter issue bonds payable from revenue funds of the
  institution unless the institution has satisfied the standards
  prescribed by the Texas Higher Education Coordinating Board for:
               (1)  space utilization in educational and general
  buildings and facilities at the institution; and
               (2)  the percentage of students enrolled in the
  institution who enroll in online courses offered by the
  institution.
         (e)  The Texas Higher Education Coordinating Board may adopt
  rules for the administration of Subsection (d).
         (f)  In this section, "educational and general buildings and
  facilities," "general academic teaching institution," and "public
  state college" have the meanings assigned by Section 61.003.
         SECTION 2.  The change in law made by this Act does not
  affect the validity of any bonds the issuance of which was
  authorized before the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2015.
