A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the eligibility to serve as a member of the board of |
|
trustees of the Texas County and District Retirement System. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 845.003, Government Code, is amended by |
|
amending Subsections (a) and (b) and adding Subsections (a-1) and |
|
(a-2) to read as follows: |
|
(a) Except as provided by Subsections (a-1) and (a-2), to |
|
[To] be eligible to serve as a trustee a person must be: |
|
(1) a member of the retirement system and an employee |
|
of a participating subdivision; [or] and |
|
(2) [a retiree of the retirement system.]a member of a |
|
county commissioners court of a participating subdivision. |
|
(a-1) The eligibility requirements under Subsection (a) |
|
apply only to six members of the board of trustees. The remaining |
|
three members must be representatives of the public. |
|
(a-2) To be eligible as a representative of the public |
|
required under subsection (a) a person must be: |
|
(1) a person who has not served in elected office; and |
|
(2) a person who has not been employed by a government |
|
entity. |
|
(b) If a person serving as a trustee ceases to meet an |
|
eligibility requirement under this section [Subsection (a)], the |
|
person shall vacate the office of trustee. |
|
SECTION 2. The change in law made by this Act to Section |
|
845.003, Government Code, regarding the eligibility requirements |
|
of members of the board of trustees of the Texas County and District |
|
Retirement System, does not affect the entitlement of a member |
|
serving on the board immediately before the effective date of this |
|
Act to continue to serve as a member of the board for the remainder |
|
of the member's term. As the terms of board members expire or as a |
|
vacancy occurs on the board, the governor shall appoint a member to |
|
the board as necessary to comply with Section 845.003(a-1) and |
|
(a-2), Government Code, as added by this Act. |
|
SECTION 3. This Act takes effect September 1, 2015. |
