A BILL TO BE ENTITLED
 
AN ACT
  relating to the eligibility to serve as a member of the board of
  trustees of the Texas County and District Retirement System.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 845.003, Government Code, is amended by
  amending Subsections (a) and (b) and adding Subsections (a-1) and
  (a-2) to read as follows:
         (a)  Except as provided by Subsections (a-1) and (a-2), to
  [To] be eligible to serve as a trustee a person must be:
               (1)  a member of the retirement system and an employee
  of a participating subdivision; [or] and
               (2)  [a retiree of the retirement system.]a member of a
  county commissioners court of a participating subdivision.
         (a-1)  The eligibility requirements under Subsection (a)
  apply only to six members of the board of trustees. The remaining
  three members must be representatives of the public.
         (a-2)  To be eligible as a representative of the public
  required under subsection (a) a person must be:
               (1)  a person who has not served in elected office; and
               (2)  a person who has not been employed by a government
  entity.
         (b)  If a person serving as a trustee ceases to meet an
  eligibility requirement under this section [Subsection (a)], the
  person shall vacate the office of trustee.
         SECTION 2.  The change in law made by this Act to Section
  845.003, Government Code, regarding the eligibility requirements
  of members of the board of trustees of the Texas County and District
  Retirement System, does not affect the entitlement of a member
  serving on the board immediately before the effective date of this
  Act to continue to serve as a member of the board for the remainder
  of the member's term. As the terms of board members expire or as a
  vacancy occurs on the board, the governor shall appoint a member to
  the board as necessary to comply with Section 845.003(a-1) and
  (a-2), Government Code, as added by this Act.
         SECTION 3.  This Act takes effect September 1, 2015.
