A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the assignment to a trial court of a judge or justice |
|
|
who was defeated in a primary or general election. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 74.053(d), Government Code, is amended |
|
|
to read as follows: |
|
|
(d) An assigned judge or justice who was defeated in the |
|
|
last primary or general election for which the judge or justice was |
|
|
a candidate for the judicial office held by the judge or justice may |
|
|
not sit in a criminal or civil case if either party objects to the |
|
|
judge or justice. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to the assignment of a judge or justice made on or after the |
|
|
effective date of this Act. An assignment made before the effective |
|
|
date of this Act is governed by the law in effect immediately before |
|
|
that date, and the former law is continued in effect for that |
|
|
purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
