A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to prohibited resident admission requirements before |
|
|
certain inspections of an assisted living facility license |
|
|
applicant. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 247.023, Health and Safety Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) The department may not require an assisted living |
|
|
facility license applicant to admit a resident to the facility |
|
|
before the department conducts an on-site health inspection for |
|
|
issuance of a license or provisional license under this chapter. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
