A BILL TO BE ENTITLED
 
AN ACT
  relating to cardiopulmonary resuscitation certification
  requirements for certain food service workers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 438, Health and Safety Code, is amended
  by adding Subchapter E to read as follows:
  SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
  CERTAIN FOOD SERVICE EMPLOYEES
         Sec. 438.051.  APPLICABILITY. This subchapter applies only
  to a food service establishment at which space for eating is
  designed or designated.
         Sec. 438.052.  CARDIOPULMONARY RESUSCITATION CERTIFICATION
  REQUIRED. (a) A food service establishment described by Section
  438.051 shall ensure that all employees of the establishment are
  certified in cardiopulmonary resuscitation.
         (b)  A food service establishment shall:
               (1)  provide training for all employees in
  cardiopulmonary resuscitation as often as necessary to maintain
  employee certification; and
               (2)  pay employees their regular wage for time spent in
  the training.
         (c)  The instructor of a training course required under this
  section must be authorized to provide the instruction by the
  American Heart Association, the American Red Cross, or a similar
  nationally recognized association.
         (d)  A food service establishment that hires an employee who
  is not certified in cardiopulmonary resuscitation shall provide
  training for that employee not later than the 30th day after the
  date of hire.
         (e)  A food service establishment may not discriminate in
  hiring based on whether an applicant is certified in
  cardiopulmonary resuscitation.
         SECTION 2.  (a)  The change in law made by this Act by adding
  Subchapter E, Chapter 438, Health and Safety Code, applies to an
  employee who is hired on or after the effective date of this Act.
         (b)  A food service establishment shall provide the training
  required by this Act for employees hired before the effective date
  of this Act not later than October 1, 2015.
         SECTION 3.  This Act takes effect September 1, 2015.
