A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to providing notification to certain legislators and |
|
|
county judges of certain applications or notices for an electric |
|
|
railway project. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 199, Transportation Code, is amended by |
|
|
adding Section 199.003 to read as follows: |
|
|
Sec. 199.003. NOTICE OF ELECTRIC RAILWAY PROJECT. If the |
|
|
department is notified of an application submitted to the federal |
|
|
Surface Transportation Board for an electric railway project in |
|
|
this state or receives a notice of intent to prepare an |
|
|
environmental impact statement for an electric railway project in |
|
|
this state, the department shall provide notification of the |
|
|
application or notice to each state senator, state representative, |
|
|
and county judge who represents a district or county, as |
|
|
applicable, that could be directly affected by the project. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
