A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice requirements for certain witnesses who are |
|
|
scheduled to appear before a grand jury. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 20, Code of Criminal Procedure, is |
|
|
amended by adding Article 20.125 to read as follows: |
|
|
Art. 20.125. NOTICE REQUIREMENT. A witness, including a |
|
|
witness who is an accused or suspected person, who does not receive |
|
|
a grant of immunity from prosecution in exchange for the witness's |
|
|
testimony before a grand jury is entitled to receive notice that the |
|
|
witness is scheduled to appear before the grand jury not later than |
|
|
the 10th day before the date that any appearance before the grand |
|
|
jury is required, unless the notice is waived by the witness. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a grand jury proceeding that begins on or after the effective |
|
|
date of this Act. A grand jury proceeding that begins before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date the proceeding began, and the former law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
