A BILL TO BE ENTITLED
 
AN ACT
  relating to the development of healthy nutrition and physical
  activity guidelines for licensed child-care providers, public
  school teachers, and public school administrators.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 114, Health and Safety Code, is amended
  by adding Section 114.009 to read as follows:
         Sec. 114.009.  NUTRITION AND PHYSICAL ACTIVITY GUIDELINES
  FOR CHILD-CARE PROVIDERS. (a) The council shall develop wellness
  guidelines to educate licensed child-care providers, public school
  teachers, and public school administrators about serving as role
  models for children by:
               (1)  practicing healthy nutrition; and
               (2)  engaging in physical activity.
         (b)  The council shall develop incentives to encourage
  licensed child-care providers, public school teachers, and public
  school administrators to follow the guidelines. 
         (c)  The council shall communicate the guidelines and
  incentives to licensed child-care providers, public school
  teachers, and public school administrators in this state in a
  manner that the council determines is appropriate.
         SECTION 2.  The interagency obesity  council shall develop
  the guidelines and incentives required by Sections 114.009(a) and
  (b), Health and Safety Code, as added by this Act, not later than
  January 1, 2016. The council shall communicate the guidelines and
  incentives as required by Section 114.009(c), as added by this Act,
  not later than July 1, 2016.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
