A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the appeal of an order authorizing the administration |
|
|
of medication to a patient receiving court-ordered inpatient mental |
|
|
health services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 574.108(b), Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
(b) An order authorizing the administration of medication |
|
|
regardless of the refusal of the patient is stayed [effective] |
|
|
pending an appeal of the order. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an appeal of an order authorizing the administration of |
|
|
medication to a patient receiving court-ordered inpatient mental |
|
|
health services that is filed on or after the effective date of this |
|
|
Act. An appeal filed before the effective date of this Act is |
|
|
governed by the law in effect when the appeal was filed, and the |
|
|
former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
