A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to parental notice on enrollment in a public school of a |
|
|
student who is not immunized. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 38.001, Education Code, is amended by |
|
|
adding Subsections (g) and (h) to read as follows: |
|
|
(g) When a person who has not received the immunizations |
|
|
required by this section enrolls in a public elementary or |
|
|
secondary school, the school shall provide notice of the person's |
|
|
enrollment and lacking immunizations to the parent or guardian of |
|
|
each student enrolled in the school. The notice may not identify |
|
|
the person lacking immunizations. |
|
|
(h) A student's parent or guardian who receives notice under |
|
|
Subsection (g) may request transfer of the student to another |
|
|
public school as provided by Subchapter B, Chapter 25. |
|
|
SECTION 2. Sections 38.001(g) and (h), Health and Safety |
|
|
Code, as added by this Act, apply beginning with the 2015-2016 |
|
|
school year. |

SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
