A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to voting methods in a property owners' association |
|
|
election or vote. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Section 209.00592, Property Code, is amended by |
|
|
adding Subsection (a-1) to read as follows: |
|
|
(a-1) Notwithstanding Subsection (a), and except as |
|
|
provided by this subsection, a property owners' association is not |
|
|
required to provide an owner with a voting method that is not |
|
|
required by a dedicatory instrument. The association must allow an |
|
|
owner to vote by absentee ballot or by proxy in any vote or election |
|
|
in which a vote may be cast or given in person. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
