A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the disposition of certain surplus property by the |
|
Department of Public Safety. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter F, Chapter 2175, Government Code, is |
|
amended by adding Section 2175.308 to read as follows: |
|
Sec. 2175.308. EXCEPTION FOR CERTAIN DEPARTMENT OF PUBLIC |
|
SAFETY PROPERTY. (a) Notwithstanding other provisions of this |
|
chapter, to support the mission of the Department of Public Safety, |
|
the department may donate or sell, at a discounted rate, directly to |
|
a local law enforcement agency: |
|
(1) a surplus law enforcement motor vehicle; or |
|
(2) other surplus law enforcement equipment, |
|
including radios, personal protection equipment, and weapons |
|
accessories. |
|
(b) The Department of Public Safety: |
|
(1) shall sell surplus motor vehicles and other law |
|
enforcement equipment under this section in its "as-is" condition; |
|
and |
|
(2) may not make any representations or warranties as |
|
to the condition or use of surplus motor vehicles and other law |
|
enforcement equipment sold under this section. |
|
(c) Revenue from the sale of motor vehicles and equipment |
|
under this section shall be deposited to the credit of the |
|
Department of Public Safety and may be appropriated only to the |
|
department. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
