A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a landlord's duty to provide a copy of a lease to |
|
|
certain residential tenants. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 92.024(b), Property Code, is amended to |
|
|
read as follows: |
|
|
(b) Not [If more than one tenant is a party to the lease,
|
|
|
not] later than the third business day after the date a landlord |
|
|
receives a written request for a copy of a lease and the payment of a |
|
|
$10 fee from a tenant [who has not received a copy of the lease under
|
|
|
Subsection (a)], the landlord shall provide one complete copy of |
|
|
the lease to the requesting tenant. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a lease that is entered into or renewed on or after the effective |
|
|
date of this Act. A lease that is entered into or renewed before the |
|
|
effective date of this Act is governed by the law as it existed |
|
|
immediately before the effective date of this Act, and that law is |
|
|
continued in effect for that purpose. |

SECTION 3. This Act takes effect January 1, 2016 |
