A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the transfer of certain state real property from the |
|
Texas Department of Transportation to the City of Laredo. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. (a) Subject to Section 2 of this Act, the Texas |
|
Department of Transportation shall transfer by appropriate |
|
instrument of transfer to the City of Laredo the real property |
|
described by Section 3 of this Act. |
|
(b) Before the transfer of a parcel of real property |
|
described by Section 3 of this Act is made, a survey of the parcel |
|
may be conducted by or under the direction of the General Land |
|
Office. |
|
(c) The City of Laredo must use the real property described |
|
by Section 3 of this Act to primarily promote a public purpose of |
|
the state by enhancing tourism and providing recreation and civic |
|
improvement. |
|
SECTION 2. (a) Ownership of the property automatically |
|
reverts to the State of Texas: |
|
(1) on request of the Texas Department of |
|
Transportation; or |
|
(2) if the City of Laredo: |
|
(A) fails to promote a public purpose of the |
|
state as described by Section 1(c) of this Act; or |
|
(B) sells all or any part of the property. |
|
(b) The state reserves: |
|
(1) the state's interest in all oil, gas, and other |
|
minerals in and under the real property described by Section 3 of |
|
this Act; |
|
(2) the state's right to remove from the real property |
|
described by Section 3 of this Act any oil, gas, and other minerals |
|
in and under the real property; and |
|
(3) the state's right to grant a lease held by the |
|
state before a conveyance of real property described by Section 3 of |
|
this Act relating to the removal of oil, gas, and other minerals in |
|
and under the real property. |
|
(c) Sections 31.1571 and 31.158, Natural Resources Code, do |
|
not apply to the transfer of real property authorized by this Act. |
|
SECTION 3. The real property held by the Texas Department of |
|
Transportation, which are remainder properties from the expansion |
|
and extension of Interstate Highway 35, which said four remnant |
|
tracts within the corporate limits of the City of Laredo and bounded |
|
on the north by Victoria Street; bounded on the east by Santa Ursula |
|
Avenue; bounded on the south by Hidalgo Street; and bounded on the |
|
west by San Dario Avenue, and are more particularly described as |
|
follows: |
|
Tract 1 (North most tract) bounded on north by Victoria Street; on |
|
the east by Santa Ursula Avenue; bounded on the south by Houston |
|
Street and bounded on the west by San Dario Avenue. |
|
Tract 2 bounded on the north by Houston Street; on the east by Santa |
|
Ursula Avenue; on the south by Matamoros Street and on the west by |
|
San Dario Avenue. |
|
Tract 3 bounded on the north by Matamoros Street, on the east by |
|
Santa Ursula Avenue; on the south by Farragut Street and on the west |
|
by San Dario Avenue. |
|
Tract 4 (Southernmost tract) bounded on the north by Matamoros |
|
Street, on the east by Santa Ursula Avenue on the south by Hidalgo |
|
Street and on the west by San Dario Avenue. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
