A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating |
|
|
to the definition of a dependent for health benefit plans |
|
|
offered by certain university systems. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1601.004, Insurance Code, is amended by |
|
|
adding Subsections (c) and (d) to read as follows: |
|
|
(c) Notwithstanding Subsection (b)(2), "spouse" means: |
|
|
(1) a husband or wife; or |
|
|
(2) a member of a civil union or similar relationship |
|
|
that is entered into in this state or another state and is between |
|
|
individuals of the same sex. |
|
|
(d) Subsection (c) takes effect only if the United States |
|
|
Supreme Court or other court of competent jurisdiction holds |
|
|
invalid, enjoins, or otherwise prevents enforcement of any law in |
|
|
this state that prohibits: |
|
|
(1) the marriage of individuals of the same sex; or |
|
|
(2) the recognition of a civil union or similar |
|
|
relationship entered into in another state between individuals of |
|
|
the same sex. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
