A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the confidentiality of certain information related to |
|
|
the operation of a municipally owned utility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 552.110, Government Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) This section does not apply to a contract between an |
|
|
electric utility, as defined by Section 31.002, Utilities Code, and |
|
|
a municipally owned utility, as defined by Section 11.003, |
|
|
Utilities Code. |
|
|
SECTION 2. Section 552.133, Government Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) Notwithstanding any other part of this section, this |
|
|
section does not apply to a contract between an electric utility, as |
|
|
defined by Section 31.002, Utilities Code, and a municipally owned |
|
|
utility, as defined by Section 11.003, Utilities Code. |
|
|
SECTION 3. The change in law made by this Act applies only |
|
|
to a request for public information made on or after the effective |
|
|
date of this Act. A request for public information made before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date of the request, and the former law is continued in effect for |
|
|
that purpose. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
