A BILL TO BE ENTITLED
 
AN ACT
  relating to the confidentiality of certain information related to
  the operation of certain municipally owned utilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 552.110, Government Code, is amended by
  adding Subsection (c) to read as follows:
         (c)  This section does not apply to a contract between an
  electric utility, as defined by Section 31.002, Utilities Code, and
  a municipally owned utility, as defined by Section 11.003,
  Utilities Code, that operates in a municipality that:
               (1)  has a population of less than 6,000; and
               (2)  is the county seat of a county that has a
  population of less than 10,000.
         SECTION 2.  Section 552.133, Government Code, is amended by
  adding Subsection (d) to read as follows:
         (d)  Notwithstanding any other part of this section, this
  section does not apply to a contract between an electric utility, as
  defined by Section 31.002, Utilities Code, and a municipally owned
  utility, as defined by Section 11.003, Utilities Code, that
  operates in a municipality that:
               (1)  has a population of less than 6,000; and
               (2)  is the county seat of a county that has a
  population of less than 10,000.
         SECTION 3.  The change in law made by this Act applies only
  to a request for public information made on or after the effective
  date of this Act. A request for public information made before the
  effective date of this Act is governed by the law in effect on the
  date of the request, and the former law is continued in effect for
  that purpose.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
