A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice concerning the availability to persons who |
|
|
transport agricultural products of an overweight vehicle permit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 12, Agriculture Code, is amended by |
|
|
adding Section 12.051 to read as follows: |
|
|
Sec. 12.051. NOTICE CONCERNING AVAILABILITY OF OVERWEIGHT |
|
|
VEHICLE PERMIT. (a) The department shall provide information about |
|
|
the permit issued under Section 623.011, Transportation Code, and |
|
|
the availability to persons who transport agricultural products of |
|
|
that permit: |
|
|
(1) on the department's Internet website; and |
|
|
(2) in any department publication related to the |
|
|
production, processing, storage, or delivery of an agricultural |
|
|
product, the transportation of which may require that permit. |
|
|
(b) The department shall adopt rules to: |
|
|
(1) provide the form and content of a notice |
|
|
concerning the permit issued under Section 623.011, Transportation |
|
|
Code, and the availability to persons who transport agricultural |
|
|
products of that permit; and |
|
|
(2) require facilities involved in the production, |
|
|
processing, storage, or delivery of an agricultural product, the |
|
|
transportation of which may require that permit, to post the notice |
|
|
in the facility. |

|
SECTION 2. This Act takes effect September 1, 2015. |
